1. acceptance of terms
by downloading, installing, or using the beeing application ("app"), you agree to be bound by these terms of service ("terms"). if you do not agree to these terms, do not use beeing.
2. description of service
beeing is a personal wellness companion application that provides mood check-in tools, breathing and regulation exercises, ambient sounds, journaling capabilities, and personalized mood pattern insights. beeing is not a medical device, therapy service, diagnostic tool, or substitute for professional mental health care.
3. eligibility
you must be at least 12 years old to create an account and use beeing. if you are under 18, you represent that your parent or legal guardian has reviewed and agrees to these terms on your behalf.
4. accounts
to access beeing's features, you must create an account with a valid email address and password. you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
5. free and premium tiers
beeing offers a free tier that includes 2 daily mood check-ins, box breathing, 4-7-8 breathing, daily quotes, the mochi companion, day and night mode, and access to crisis resources.
beeing premium ($2.99/month or $19.99/year) unlocks unlimited check-ins, all 6 regulation tools, all ambient sounds, personalized mood insights, the weekly beeing check letter, voice moments, and smart coping suggestions. premium includes a 7-day free trial for new subscribers.
6. subscriptions and billing
premium subscriptions are billed through apple's app store or google play. payment is charged to your app store account at confirmation of purchase. subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. you can manage and cancel your subscription in your device's app store settings.
7. intellectual property
beeing, the beeing name, mochi, and all associated designs, artwork, code, and content are the intellectual property of beeing and its creator, anthony frazier. you may not copy, modify, distribute, sell, or lease any part of beeing or its content without prior written permission.
8. user content
you retain full ownership of all content you create within beeing, including journal entries, mood check-ins, and any text you write. we do not claim any rights over your content. your journal entries and mood data are used solely to provide you with personalized insights and are never shared with third parties.
9. privacy
your privacy is important to us. please review our privacy policy, which explains how we collect, use, and protect your information.
10. prohibited uses
you agree not to:
- use beeing for any unlawful purpose or in violation of any applicable laws
- attempt to reverse engineer, decompile, or disassemble the app
- interfere with or disrupt the app's servers or infrastructure
- attempt to access another user's account or data
- use beeing to provide medical or therapeutic advice to others
11. crisis resources disclaimer
beeing provides a direct link to the 988 suicide and crisis lifeline as a resource. beeing is not a crisis service and does not provide emergency support. if you are experiencing a mental health emergency, please contact 988, call 911, or go to your nearest emergency room.
12. disclaimers
beeing is provided on an "as is" and "as available" basis. we make no warranties, expressed or implied, regarding the app's reliability, accuracy, or availability. mood insights, pattern observations, and coping suggestions are informational only and do not constitute professional medical or psychological advice.
13. limitation of liability
to the maximum extent permitted by law, beeing and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app, including but not limited to emotional distress, loss of data, or reliance on app content.
14. termination
we reserve the right to suspend or terminate your account at any time for violation of these terms. you may delete your account and all associated data at any time from within the app.
15. changes to terms
we may update these terms from time to time. continued use of beeing after changes constitutes acceptance of the revised terms. we will notify you of significant changes through the app or via email.
16. governing law
these terms are governed by and construed in accordance with the laws of the state of california, without regard to its conflict of law provisions.
